Yesterday (November 20), Germany's highest civil court ruled against Kraftwerk in a copyright suit, overturning a ruling from a Hamburg state court that established that repurposing even the smallest sample of a song counts as copyright infringement, according to an AP report. The sample in question is a two-second piece of Kraftwerk's "Metal on Metal", which German rap producer Moses Pelham (the defendant in the case) used in Sabrina Setlur's 1997 track "Nur Mir". Man, of all the samples there have been [...]

Every once in a while Cyndi Lauper shows up where you least expect her to. I never thought I'd be spending Christmas with her and the Hives, but here they are together on "A Christmas Duel". As previously reported, the track will be on the Hives website as a free download November 28-30 and in music stores in the UK December 1 and in the States the next day from the Orchard. As for the song itself, it sounds like they've [...]

Blackout Beach's Skin Of Evil is a monster of an album, and not just because Carey Mercer often sounds like one while incanting his dark Bowie-on-Scott Walker woe. A month or so ago we gave you "Cloud Of Evil" from the Frog Eyes frontman's second solo offering (it follows 2004's Light Flows The Putrid Dawn). The release date was pushed back some, so please take home album closer "Astoria, Menthol Lite, Hilltop, Wave of Evil, 1982" for the time being. Like [...]

Guy Peellaert, the Belgian artist probably best known to rock fans as the artist behind the cover for David Bowie's Diamond Dogs, died on Monday in Paris. Peellaert was an accomplished comic strip artist who designed posters for films like Taxi Driver and Paris, Texas as well as the decidedly creepy cover for the Bowie album, which at first included visible genitalia for Bowie's man/dog. Peellaert's book with writer Nik Cohn, Rock Dreams, sold a million copies (thanks in part to [...]

Photo by Dan MonickThe sophomore long-player from slightly troubled Twin City twosome Atmosphere, 2002's God Loves Ugly, has languished in out-of-print purgatory for a good year now. All that changes January 20, when Rhymesayers issues a remastered, repackaged version of the set on CD and LP, coupled with a copy of what was originally the limited edition Sad Clown Bad Dub 4 (The GodLovesUgly Release Parties) DVD. The visual portion of the proceedings features more than two hours of performances, backstage [...]

In the annals of popular music, certain albums stand out for their sheer percentage of hit-bound material. Michael Jackson’s Thriller is the most famous, not just because it spun off seven Top 10 singles—the first album to do so—but because the whole disc had only nine tracks. That’s a stunning 78% hit ratio. Shania Twain’s Come on Over, roughly 70% of which charted on the country and pop charts over the course of two years, is nearly as legendary. More recently, [...]

An appeals court in Berlin has overturned a lower court's decision that producer Moses Pelham was in the wrong for sampling two seconds of Kraftwerk's "Metal on Metal" on a 1997 track. The ruling sends the case back down to a lower court, although you have to think somewhere Gregg Gillis is celebrating. The higher court stated that the amount of the song sampled was insignificant, and that the sample was used in a manner significantly different than the original track. [...]

Antony and the Johnsons, New Pornographers frontman A.C. Newman, No Age, Goblin Cock (featuring Pinback's Rob Crow), and Unicorns offshoot Clues lead the initial lineup charge for 2009's Noise Pop Festival, exploding all over San Francisco February 24-March 1. In addition to these early confirmations, Noise Pop will host a film festival featuring screenings of Johnny Cash at Folsom Prison and Agile Mobile Hostile: A Year with Andre Williams, a documentary about the R&B songwriter, among other movies. Asthmatic Kitty’s newest signee Fol Chen seems pretty wacky based entirely on this one song I’ve heard. But hey, this song’s pretty good so they’ve got my vote. Michael Sahl/J. K. Randall - split release This LP is all about the interaction between violin and electronics. Michael Sahl's "A Mitzvah for the Dead" is on the first side and J. K. Randall's "Lyric Variations for Violin and Computer" is on the other side. Paul Zukofsky performs on violin on both pieces. About "A Mitzvah for the Dead": The word mitzvah is used in a incorrect way here, but that

Maybe his new labelmates Sonic Youth told him about their "free biscotti for life" cards, and he just couldn't resist. A.C. Newman, New Pornographers frontman and solo artist, will offer up his, er, take on a-ha's "Awesome 80s Dance Mix" staple (and totes great song) "Take on Me" for a Starbucks Valentine's Day-themed compilation. No word on any more release details, though one assumes as soon as the coffee cups go all seasonal red, you can cop Carl's cover and more [...]

Yes Man is a new Jim Carrey movie any observant person (I am hardly the first) will tell you looks a lot like another Jim Carrey movie from a few years ago. It hits theaters December 19. Carrey's co-star in the film, She & Him's Zooey Deschanel, portrays the leader of Munchausen by Proxy, a sorta-fictional band made up of Deschanel and San Francisco power trio Von Iva. We say sorta-fictional because the very real soundtrack for Yes Man features four [...]

For a couple nights before Christmas, KROQ's putting on their Almost Acoustic Christmas event at the Gibson Ampitheater in Los Angeles. One evening's heavier (AFI, Offspring, etc.) and one's only heavy emotionally (the Cure, the Killers, Death Cab, Franz Ferdinand, Vampire Weekend), but both feature Scott Weiland: He appears with STP 12/13, by his lonesome 12/14. Hopefully he lays off the eggnog.

If you’re anything like me, these dark mornings and evenings a little depressing. If you go to and come home from work in the dark and have forgotten what the sun, no matter how cloud covered, looks like then this might be for you. Midlake released The Trials of Van Occupanther in 1996, having reinvented themselves from jazz roots to indie rock, and have since become one of our favorite bands. In `97 they began recording their follow-up and released a beautiful acoustic EP, Oak and Julian. We still have a good amount to record, [...]

Lucas' IMterview with an anonymous person straddling the world of Christian and indie brought up some affection for Anathallo, an act walking that same tightrope. Their first album for once-hipster-beloved label Anticon hit stores on Tuesday while I was otherwise occupied, but I'd be remiss if I didn't tell you that it's worth a listen for anyone who would like their indie folk mixed with sweet harmonies, autoharp, and a barrage of instruments usually left to orchestras. (I didn't notice any [...]
